PETITION POUR LE RESPECT DE LA LOI TEPA ET SON APPLICATION AUX PRATICIENS HOSPITALIERS

 

Les relations entre les contribuables et l'administration trouvent leur fondement dans la " Déclaration des droits de l'Homme et du Citoyen " à laquelle se réfère le préambule de la Constitution : « le principe de l'impôt est légitime. Le citoyen consent à l'impôt. Les contribuables sont égaux devant l'impôt ».

 

Chers confrères, nous sommes tous des démocrates, des républicains. Personne, ne peut remettre en cause l’importance de nos engagements humains et déontologiques auprès des malades, comme étant une véritable mission de service public.

 

Nous exerçons notre métier tous les jours dans avec des conditions de travail de plus en plus dégradées.

 

La loi TEPA basée sur le fameux « travailler plus pour gagner plus » est une loi pour tous. Par conséquent depuis le mot d’ordre de l’AMUF le 25 ami 2011, certains médecins ont obtenu la défiscalisation de leur temps additionnel (Chalon, Perpignan , Pau, Lille,  Macon, Arles….). Mais voilà, cette défiscalisation est centre des impôts dépendant. D’une ville à l’autre les réponses sont différentes, et certain se sont vu refusées l’application de la loi TEPA sans aucune raison (Tourcoing, Avignon, Armentières, Paris….).

 

L’article 1er de la loi travail, emploi, pouvoir d’achat (TEPA) a fait l’objet pour son application aux agents publics d’un décret n°2007-1430 du 4 octobre 2007. Ce décret a pris effet le 1er octobre 2007. Il concerne les éléments de rémunération versés aux agents publics titulaires ou non titulaires au titre, selon des modalités prévues par décret, des heures supplémentaires qu'ils réalisent ou du temps de travail additionnel effectif. La loi TEPA permet à chaque contribuable fonctionnaire et assimilés comme nous, médecins hospitaliers temps pleins salariés de défiscaliser des heures supplémentaires (temps additionnel). Le temps additionnel effectué par un praticien hospitalier est conforme au critère décrit par l’article 81-quater (5°) du code général des impôts.

 

Nous sommes victimes d’une discrimination flagrante et nous défendons le principe d’équité devant la loi et l’impôt pour les médecins salariés de l’hôpital public
